Homestead on vacant land

Question 1. Property owner receives Homestead exemption on his waterfront home. He applies for a demolition permit and has the home removed, by choice, so he can build a brand new stilt home. He moves across the street and resides with some friends while his new home is being constructed, never filing for Homestead anywhere else. Is he entitled to keep his Homestead on the vacant land with no improvements assessed on the parcel? For how long, up to two or three years? Until his new home is complete?

How do you add on the new structure, do you deduct the value of the old structure and maintain the cap only on the land?

Question 2. Property owner receives Homestead on his Mobile Home. He voluntarily removes the old Mobile Home and resides in a RV while his new home is under construction. Is he entitled to keep his Homestead on the vacant land (the RV is on wheels and requires a motor vehicle tag) with no improvements assessed on the parcel? For up to two or three years? Until his new home is complete?

How do you add on the new structure, do you deduct the value of the old structure and maintain the cap only on the land?

Question 3. Property owner has Homestead, his house burns to the ground. He rents an apartment while he rebuilds his home, never filing for Homestead anywhere else. Can he keep his Homestead on the vacant land? For up to two or three years? Until his new home is complete and assessed on the Tax Roll?

How do you add on the new structure, do you deduct the value of the old structure and maintain the cap only on the land?

Forum: Exemptions

Real Estate Purchase Contracts used as a conveyance

We have had a large amount of people filing for homestead exemption here in Polk County. They believe that they obtained title when they received a Real Estate Purchase Contract or an Agreement to Sell Real Estate. They don't read like a Contract for Deed or an Agreement for Deed. They read just like a contract to purchase property that you would sign with a Realtor when agreeing to purchase property. Does anyone change ownership on the parcel with these documents and allow homestead exemption?

Forum: Exemptions

Husband and wife own a property together, only the husband applied for and received the Homestead and cap. They separate and file for divorce and the husband moves off the property in 2007 and wants to port for 2008. The wife just files for Homestead on this same property for 2009. Can the husband port all or only 50% of the cap to his new property for 2008?

Forum: Exemptions

Multiple Homesteads/One Parcel

Good morning,
We have several parcels in Hernando County that have more than one owner occupying separate homes on the same parcel. Each owner qualifies for his/her own Homestead on the living unit that he/she occupies.

Are you aware of the statute, if any, that clearly dictates "one Homestead per parcel"? I appreciate feedback from anyone that has encountered and researched similar circumstances or if there is an AGO, please provide me with a copy.

Sincerely,

Paulette Stearns, CFE
Director of Public Services & Exemptions
Hernando County Property Appraiser's Office

Forum: Exemptions

Partial Exemptions for TPP accounts

Is anyone besides myself also handle the TPP exemptions?

1) If you have an business that is under $25,000 in asset value, which exemption application would you think takes priority? The $25,000 TPP asset exemption or the institutional exemption?

2) On TPP accounts that have a partial exemption (assisted living, Elks club, American Legion, etc), what should the priority be for calculating the exemptions? Which exemption gets calculated first; the TPP asset exemption or the institutional exemption?

Scott
Manatee

Forum: Exemptions

501R

Dade had a great idea!
When you are filling out a 501R for another county, if you can put the receiving county's parcel identifying number next to the applicant's name they can easily find their 501T. This is especially helpful for the counties that are emailing them back and forth. This is how I have been sending my 501R's from Orange along with an email identifying the parcel, just in case.

Forum: Exemptions

Certified Hx Denials

I'm curious if any PA offices have tried the USPS "electronic" return receipts instead of getting the green receipts mailed back to you. Getting the green card back costs $ 2.15, vs. electronic receipt at .85. With certified and postage, it brings the cost of the denial with the card returned to $ 5.21 each. We anticipate over 4000 denials this year, so the price to get the green card back is enormous. Any other creative alternatives out there?

Forum: Exemptions
